Cross-Border Trade Dispute Settled Through Mediation


A longstanding trade dispute between Canadian company as buyer for purchasing excavators from Shandong Machinery Co., Ltd. was amicably resolved through mediation led our Law Firm. The conflict arose from delayed contractual obligations under agreement, but increased the prices unilaterally, resulting in financial losses for buyer. Under the terms of the mediated agreement, the supplier agreed to refund buyer within five days, along with compensations. The resolution was reached after extensive negotiations, during which attorney emphasized legal obligations under China’s Civil Code (Articles 509, 577) and guided the parties toward a mutually acceptable compromise
The successful mediation highlighted the strategic application of Chinese law in resolving cross-border commercial disputes. Attorney leveraged the agreement’s dual-language clause, which binds both parties to Chinese jurisdiction. By invoking provisions for contract termination and liability under the Civil Code, the firm secured a swift resolution that protected buyer’s financial interests. The outcome underscores the efficiency of mediation backed by robust legal analysis, enabling parties to avoid prolonged court battles and achieve closure aligned with their commercial priorities.
